This Equipment Rental Agreement (the "Agreement") is entered into as of ______________ by and between ______________, located at ______________ ("Owner"), and ______________, located at ______________ ("Renter").
Owner agrees to rent to Renter, and Renter agrees to rent from Owner, the following equipment (the "Equipment"): ______________. A pre-rental inspection shall be conducted by both parties at the time of pickup, and any pre-existing damage shall be documented in writing and initialed by both parties. Renter's acceptance of the Equipment without objection constitutes acknowledgment that the Equipment is in the condition described above.
The Equipment shall be available to Renter from ______________ through ______________ (the "Rental Period"). Renter shall return the Equipment to Owner at Owner's location (or the drop-off location specified by Owner) by ______________. Late returns shall be charged at the agreed daily rental rate for each day or partial day the Equipment is held beyond the scheduled return date.
Renter shall pay Owner: (a) a rental fee of ______________, with a total estimated fee of $0.00 for the Rental Period; and (b) a security deposit of $0.00, due upon signing. The security deposit shall be held by Owner and returned to Renter within 10 business days after the Equipment is returned in the same condition as rented (ordinary wear and tear excepted), net of any deductions for damage, missing parts, cleaning, or outstanding rental fees.
Renter shall use the Equipment only for the following purposes: ______________. Renter shall not: (a) use the Equipment for any unlawful purpose or in violation of applicable safety regulations; (b) modify, alter, or disassemble the Equipment without Owner's written consent; (c) sublease or lend the Equipment to any third party; (d) remove the Equipment from the agreed use location without Owner's written consent; or (e) use the Equipment beyond its rated capacity or in any manner that could cause damage.

Renter shall maintain the Equipment in good working order during the Rental Period, including checking fluid levels and performing operator-required maintenance as specified in the Equipment's operating manual. Renter shall immediately notify Owner of any mechanical failure, accident, or malfunction. Renter shall not attempt to repair the Equipment without Owner's prior written authorization.

______________. Upon return of the Equipment, Owner and Renter shall conduct a joint post-rental inspection. Renter shall be responsible for all documented damage beyond ordinary wear and tear, including repair costs at Owner's selected repair facility. If the Equipment is damaged beyond economic repair or is lost or stolen during the Rental Period, Renter shall pay Owner the replacement value of the Equipment. Owner shall have the right to retain the security deposit and to pursue additional recovery for damages exceeding the security deposit.
Renter shall indemnify, defend, and hold harmless Owner from any and all claims, damages, and expenses (including attorney's fees) arising from Renter's use of the Equipment during the Rental Period, including any injury to persons or property caused by the Equipment while in Renter's possession.
Owner may immediately repossess the Equipment, without prior notice, if: (a) Renter fails to pay rent when due; (b) Renter uses the Equipment in violation of this Agreement; (c) Owner has reasonable cause to believe the Equipment is being misused or is at risk of damage or loss; or (d) Renter becomes insolvent or files for bankruptcy.
This Agreement shall be governed by and construed in accordance with the laws of the State of ______________, without regard to its conflict-of-laws principles.
