This Landscaping and Lawn Care Contract (the "Contract") is entered into as of ______________ by and between ______________, located at ______________ ("Company"), and ______________, located at ______________ ("Client"), for services at the following property: ______________ (the "Property").
Company agrees to provide Client with the following landscaping and lawn care services at the Property: ______________. Services shall be performed in a professional, workmanlike manner and in accordance with applicable industry standards and local regulations. Company's employees and subcontractors hold all required licenses for the services described herein, including applicable pesticide applicator licenses required by federal and state law.
The following services are NOT included in this Contract and will require a separate written estimate: Any services not expressly listed in Section 1 above.. Client acknowledges that additional work beyond the scope of this Contract shall not be performed without a separate written authorization.
Company shall provide the services described in Section 1 on the following schedule: ______________. Company shall have the right to skip or adjust services during periods of drought (when mowing is unnecessary), extreme weather, or at Company's professional judgment when conditions are unsuitable for safe or beneficial lawn care. Skipped services due to weather or access issues shall not result in credits against the fees owed.
Client shall pay Company $0.00 per month for the services described herein. Invoices shall be issued on the first of each month and are due within 15 days of the invoice date. Accounts more than 30 days past due shall be subject to a 1.5% monthly late fee. Company reserves the right to suspend services for accounts more than 45 days past due, without waiving its right to payment.
This Contract shall govern services on a undefined basis, as described herein.
Client acknowledges and consents to the application of pesticides, herbicides, and fertilizers on the Property as described in this Contract. Company shall: (a) use only registered pesticides and apply them in accordance with label directions under FIFRA; (b) provide Client with at least 24 hours' notice before pesticide applications (except emergency applications for active pest infestations); (c) maintain application records as required by law; and (d) provide Client with product labels or Safety Data Sheets upon request. Client shall keep people and pets off treated areas for the period specified on each product's label. Client is responsible for informing all household members and guests of chemical applications.
Company shall use reasonable care to avoid damage to the Property. Company shall promptly report any damage caused by Company's equipment or personnel to Client and shall be responsible for repairing or paying for damage caused by Company's negligence. Company shall not be responsible for: (a) underground utilities not properly marked by the applicable utility company; (b) irrigation system damage when sprinkler heads are not properly marked by Client; (c) damage to lawn furniture, decorations, or items left in work areas; or (d) normal wear and turf damage resulting from drought, disease, or other natural conditions. Client shall mark all irrigation heads, invisible dog fence lines, and underground utility lines before Company commences work.
Company shall maintain commercial general liability insurance with limits of not less than $1,000,000 per occurrence and workers' compensation insurance as required by applicable law. Company shall provide Client with a certificate of insurance upon request. In the event of a claim for property damage, Client shall notify Company within 5 business days of discovering the damage.
Client grants Company and its employees and equipment access to the Property during scheduled service hours. Client shall ensure that dogs and other animals are secured and that the Property is accessible on the scheduled service days. If Company is unable to access the Property due to a locked gate, vehicle obstruction, or dog that is not secured, Client shall be charged the full service fee for the missed visit.
This Agreement shall be governed by and construed in accordance with the laws of the State of ______________, without regard to its conflict-of-laws principles.
