This Parking Space License Agreement (the "Agreement") is entered into as of ______________ by and between ______________, located at ______________ ("Licensor"), and ______________, located at ______________ ("Licensee").
Licensor hereby grants to Licensee a non-exclusive, revocable, personal license to use the following designated parking space(s): ______________ (the "Parking Space"), located at ______________ (the "Facility"), for the purpose of parking the following vehicle(s): ______________ (the "Vehicle"). This Agreement grants Licensee a personal license only and does not create a tenancy, leasehold, or any other interest in real property. Licensee may not assign this license or permit any person other than Licensee to use the Parking Space without Licensor's prior written consent.
This Agreement shall commence on ______________ and shall expire on ______________, unless sooner terminated in accordance with this Agreement. After the expiration of the fixed term, this Agreement shall convert to month-to-month unless renewed in writing by the parties.
Licensee shall pay Licensor a monthly license fee of $0.00 (the "License Fee"), due and payable in advance on the ______________ of each calendar month. License Fee payments shall be made by [payment method to be specified by Licensor]. Late payments shall accrue a late fee of $25 per day after the 5th of the month. Licensor may terminate this Agreement immediately upon 3 days' written notice if the License Fee is not paid within 10 days of its due date.
Licensee may use the Parking Space only for the parking of the Vehicle(s) described above. Licensee shall not: (a) use the Parking Space to store any property other than the Vehicle; (b) perform mechanical work or repairs on the Vehicle in the Parking Space; (c) store hazardous materials, flammable substances, or illegal items in the Parking Space or the Vehicle; (d) permit unauthorized vehicles to use the Parking Space; or (e) sublicense or permit third-party use of the Parking Space. Access to the Facility is permitted during the following hours: ______________. Licensor may designate specific parking procedures, access protocols, and facility rules, with which Licensee shall comply.
Licensor is not a bailee of the Vehicle. Licensor does not accept custody or responsibility for the Vehicle or any personal property therein. Licensor shall not be liable for theft of, or damage to, the Vehicle or any personal property contained therein, unless caused by Licensor's gross negligence or willful misconduct. Licensee is responsible for maintaining adequate auto insurance on the Vehicle.
Licensee shall: (a) park within the boundaries of the designated Parking Space and not encroach on adjacent spaces; (b) maintain the Vehicle in a non-leaking condition and promptly clean up any fluid leaks; (c) comply with all posted parking rules and regulations; (d) not store vehicle parts, tires, or other property in the Parking Space; and (e) surrender the Parking Space in the same condition as received upon termination.
This license is revocable at Licensor's discretion. In addition to any right of termination for non-payment, Licensor may revoke this license upon 30 days' written notice for any reason. Licensor may revoke immediately upon written notice if Licensee: (a) repeatedly violates parking rules; (b) permits unauthorized vehicle use; (c) creates a nuisance; or (d) commits any act that poses a safety risk to the Facility or its occupants.
This Agreement shall be governed by and construed in accordance with the laws of the State of ______________, without regard to its conflict-of-laws principles.
