This Remote Work Agreement (the "Agreement") is entered into as of ______________ by and between ______________, located at ______________ (the "Employer"), and ______________, located at ______________ (the "Employee"), employed in the position of ______________.
This Agreement supplements and does not supersede the Employee's existing employment agreement or offer letter. In the event of a conflict, this Agreement controls with respect to remote work matters.
Subject to the terms of this Agreement and Employer's ongoing approval, Employee is authorized to work remotely on the following basis: ______________. The approved remote work location is: ______________ (the "Remote Location"). Employee shall not perform work from any other location without Employer's prior written approval. Employee shall promptly notify Employer of any change in remote work location, including temporary relocations exceeding five (5) business days.
Employee shall maintain the following work schedule while working remotely: ______________. Employee shall be accessible via Employer's designated communication channels (email, phone, video conferencing) during all scheduled work hours and shall respond to communications within the same timeframes as required in the office. Employee shall attend all required meetings, whether in-person or virtual, as scheduled by Employer.
Remote work is a privilege, not an entitlement. Employee shall maintain the same or higher level of performance, productivity, and professionalism while working remotely as expected in the office. Employer shall evaluate remote work performance using the same standards and metrics applied to in-office performance. Employer may revoke remote work authorization at any time, with or without cause, upon reasonable notice, and may require Employee to return to in-person work.
Employee shall provide and maintain, at Employee's own expense, all equipment necessary for remote work, including a suitable computer, reliable high-speed internet connection, and any other required hardware.
Employee shall: (a) use only Employer-approved devices and Employer's VPN when accessing Employer's network, systems, or confidential data; (b) ensure that all Employer devices and storage media are encrypted; (c) use only password-protected, secured wi-fi networks — public or shared networks are prohibited for work involving confidential data; (d) maintain a dedicated, private workspace that prevents unauthorized viewing of Employer's confidential information by family members, roommates, or other third parties; (e) immediately report any suspected security breach, lost device, or unauthorized access to Employer's IT department; and (f) comply with all of Employer's information security policies and procedures, as may be updated from time to time.
Employer shall not provide any reimbursement for home office expenses, utilities, internet, or personal equipment. Employee acknowledges that no additional compensation is owed for remote work costs.
Employee represents that the Remote Location is safe, free from known hazards, and suitable for the performance of work duties. Employee shall comply with Employer's remote workplace safety guidelines and shall promptly report any work-related injury or illness occurring at the Remote Location. Employee acknowledges that workers' compensation coverage extends to work-related injuries occurring at the Remote Location during scheduled work hours.
Employee acknowledges that working remotely from a state other than Employer's principal place of business may create income tax obligations in multiple states. Employee is responsible for understanding and complying with all applicable tax laws regarding remote work. Employer shall withhold state income taxes for the state in which Employee's approved Remote Location is situated, and Employee consents to such withholding adjustments.
Employee acknowledges that Employer has the right to monitor Employer-owned devices, systems, network activity, email, and electronic communications used for work purposes, to the extent permitted by applicable law. Employer's right to monitor extends to any use of Employer systems or data, regardless of the device used. Employee has no expectation of privacy with respect to work activities conducted on Employer's systems or devices.
Employer reserves the right to modify, suspend, or terminate this remote work arrangement at any time, for any reason or no reason, upon reasonable notice. Employee may request termination of this Agreement to return to full in-office status upon 30 days' written notice.
This Agreement shall be governed by and construed in accordance with the laws of the State of ______________, without regard to its conflict-of-laws principles.
